New PA Law Affects Certain Disputes in Community Associations

On May 7, 2018, Governor Wolf signed into law Act 17 of 2018, which will take effect in 60 days. The legislation was originally introduced in 2016, and has been modified several times since then. The new law provides that, in certain situations, unit owners in condominiums, cooperatives and homeowner associations will be able to utilize alternative dispute resolution procedures to try to resolve issues relating to association meetings, quorums, voting, and association records. Under these amendments to the three existing community association statutes, unit owners in good standing may file complaints regarding such matters to the Bureau of Consumer Protection in the Office of the PA Attorney General, for investigation and mediation.
