Firm attorney Lee Applebaum obtained a judgment in favor of an insurance carrier before Philadelphia’s Commerce Court, with the Court ruling that there was no duty to defend or indemnify the insured in an underlying action. The underlying case had been stayed pending the resolution of the declaratory judgment action, which was decided on a Motion for Judgment on the Pleadings.
