My company terminated an older worker due to poor job performance, and we have now received notice that he has filed an age discrimination claim against us with the EEOC. Do we need to hire a lawyer at this point?

The EEOC will ask you for information relating to the employee and your response to his claim against you. All documents, statements or other information which you provide to the EEOC may be obtained by the plaintiff and his attorney in the event a lawsuit is filed. It is always best to consult counsel before providing information that may determine the outcome of a costly lawsuit against your company.
