Joseph J. Hamill, Jr.

Joe is a seasoned litigator/trial attorney, who is respected by his peers, having been named a Philadelphia Super Lawyer five out of the last six years. His experience ranges from simple premises liability cases through complex FDA cosmetics regulatory matters to providing advice on cyber security and data privacy.

AVIATION, TRANSPORTATION AND COMPLEX LITIGATION EXPERIENCE

Joe started practicing in 1989 as an associate in New York focusing on aviation product liability litigation. During his four years in New York, Joe primarily represented manufacturers of commuter aircraft and manufacturers of aircraft engines in multidistrict litigation.

In 1993, Joe moved to Philadelphia where he continued his involvement in complex litigation, including fire litigation, construction litigation, antitrust litigation and litigation arising from outbreaks of communicable diseases. Furthermore, he broadened his aviation experience representing international airlines in actions brought under the Warsaw and Montreal Conventions and domestic carriers in personal injury litigation. Additionally, he has represented airport third party maintenance entities in premises liability actions brought as a result of accidents that occurred at PHL.

Also, Joe represented entities in products liability litigation, focusing on defendants in the chain of distribution of products in transportation litigation. He has represented manufacturers of bicycles, high speed trains, trailers and automobile component parts. Joe represented the manufacturer in the very first alleged defective design anti-lock brake case. Finally, he represented a local manufacturer of trailers in two actions alleging that the trailers’ rear under ride guards were defectively designed, resulting in catastrophic brain damage to the plaintiffs. After lengthy trials, both actions resulted in defense verdicts.

Joe has also been involved in coverage issues as it relates to his aviation experience. He has provided expert opinion regarding the charter air industry as it pertained to a charter aircraft company that declared bankruptcy. He also has assisted in providing coverage opinions with respect to crashes of corporate aircraft.

Finally, Joe has been involved in helicopter litigation. He represented the lessee of a twin rotor helicopter that crashed while ferrying logs in British Columbia resulting in the deaths of the two pilots.

COMMERCIAL LITIGATION, FDA REGULATORY LITIGATION AND CYBER SECURITY AND DATA PRIVACY

In addition to his defense work on personal injury litigation, Joe represents companies in various commercial matters.
Joe has significant experience in commercial disputes between companies, representing both large international companies and small local companies. He has significant experience in representing e-commerce companies, such as Smooth Fitness, the country’s # 1 e-retailer of home fitness equipment. He became intimately knowledgeable with Google Analytics and search engine optimization (“SEO”). Subsequently, he has become very active in cyber security and data privacy. He is on the Steering Committee of the Defense Research Institute’s (“DRI”) Cyber Security and Data Privacy Committee. In addition, he is the Chairman of DRI’s Insurance Subcommittee on Cyber Security. Finally, he is Vice-Chair of the Philadelphia Bar Association’s Business Section’s Cyber Security Committee.

Recently, Joe concluded successfully the prosecution of a breach of contract action on behalf of a distributor/retailer of cosmetics against its manufacturer who had failed to manufacture cosmetics in accordance with accepted manufacturing practices pursuant to FDA regulations.

He has performed workplace investigations involving claims of discrimination based on sex and race that also involved claims of retaliation. He has conducted risk management workshops for employers regarding best practices for hiring and firing. He has prepared workplace manuals for small businesses. Joe has litigated employment discrimination claims. Finally, Joe has been involved in several matters regarding the validity of non-compete agreements.

Finally, he has represented the largest Philadelphia residential real estate broker in various breach of contract matters, and a Philadelphia law firm in a complex breach of fiduciary duty/malpractice action brought by alleged former clients of the firm that resulted in dismissal with prejudice of the claim.

HOSPITALITY AND RETAIL

Joe also has extensive experience in the hospitality industry, representing hotel owners, licensors, and licensees in litigation in Pennsylvania, New York and Massachusetts. The types of cases in which Joe has worked on include slip and falls, trip and falls, alleged improperly working electronic opening doors, Dram Shop, carbon monoxide poisoning and cases arising from Hurricane Sandy.

Joe represents national retail chains in personal injury litigation. He has successfully uncovered fraudulent claims resulting in dismissal of actions brought against his clients.

Joe joined Fineman Krekstein & Harris, P.C. in March 2013. He has been named a Philadelphia Super Lawyer in commercial litigation from 2012-2014, 16-17.
